Access Terms of Service |
These Terms of Service (hereinafter
called Terms) represents the entire agreement between WestPAnet, Inc.
(hereinafter called WestPA.net) and the purchaser of broadband service
(hereinafter called Customer). WestPA.net reserves the right to modify
these Terms at any time. Check this webpage for updates.
WestPA.net offers various levels of Broadband Internet Service
(hereinafter called Service) over a Cable TV system owned by WestPA.net.
Customer's initial use of the Service indicates agreement with all of
the Terms included in this document.
Billing, Refunds and Payments
If you have just signed up for Service and do not agree to these Terms
you can terminate Service and receive a refund within 5 business days of
your signup. Otherwise, Service fee will be refunded on a pro-rated
basis.
Customer’s Internet payment is due to WestPA.net on the 5th day of each month. WestPA.net reserves the right to suspend
Service without notice if customer fails to pay either the Internet
Service or the cable TV service. Customer’s e-mail, web site and
username will be eliminated at the discretion of WestPA.net for
suspended Customers.
Number of Computers
WestPA.net does not limit the
number of computers you connect through a router; however we are only
responsible for the delivery of the cable Internet to the cable modem
and the device present at the time of installation. Service calls
required because of failure or misconfiguration of customer installed
equipment or networks will result in an hourly charge of $65.
Confidentiality
WestPA.net believes in your privacy. We do not monitor customer e-mail
or activities. We do NOT sell or release your personal information to
third parties! You have given us your trust and we won't make money
selling your address to others. Your information will not be used or disclosed
other than for the purposes for which such information was collected, or
as required by law.
Anti-virus
Customer will
use suitable virus scanning software to prevent the spread of computer
related viruses. We do provide assistance via telephone as well as
information regarding virus scanning software packages.
Unacceptable Customer Practices
WestPA.net provides Service appropriate for general consumer use. The
operation of FTP servers, chat servers, P2P networks, or other elements
entailing a dedicated use of our equipment is prohibited.
Customer agrees not to allow connection to be used in any way that could
disrupt WestPA.net or other Customer’s connections.
Customer may not modify their PC, cable modem, or any other device to
attempt to gain a static IP address or higher levels of Service beyond
their purchased level. No attempts will be made to alter any equipment
to modify or present a chance to modify Service provided by WestPA.net.
All IP addresses must be accepted by Customers equipment after a valid
DHCP request.
Excessive use of data transfer or network resources is not permitted.
Customers discovered to be using, what WestPA.net deems as excessive
bandwidth, may be disconnected at the discretion of WestPA.net.
Customers may not modify software or hardware to override variables set
by WestPA.net. Tampering with hardware or software of cable modems
connected to the cable network will result in immediate termination of
Service and/or other remedies, including legal action.
Customers will not modify the physical cable connection. The cables,
splitters, and any other device connected must remain intact at all
times. Any interference caused by changes made by the Customer could
result in termination of Customer’s Service.
The following actions are also prohibited and are grounds for
termination of your account:

Using your WestPA.net account or
e-mail sent from or through the WestPA.net system to harass, threaten or
interfere with any other Internet user.

Committing, or discussing with the
intention to commit, illegal activities. Transmission or maintenance on
any WestPA.net servers, material, information or software in violation
of any local, state or federal law.

Attempting to gain unauthorized
access to any part of the WestPA.net system or in any way tampering
without permission.

Spamming - We define spamming as
sending the same unsolicited email to more than twenty-five (25) email
recipients.

Falsifying any information provided
to WestPA.net.
When appropriate, WestPA.net will
attempt to give notice of a violation to allow the offending party to
remedy the problem prior to action. However, WestPA.net reserves the
right to take whatever immediate action our personnel deem necessary.
Violation of these Terms may result in filtering, blocked access,
termination of Service(s) or other appropriate actions as solely
determined by WestPA.net. Refunds or credits are not issued in
connection with any action resulting from violations of these Terms.
Customer agrees to indemnify WestPA.net for any losses, costs, damages,
or attorneys' fees incurred by WestPA.net and relating to, or arising
out of your breach of this section. Nothing contained in these Terms
shall be construed to limit WestPA.net 's actions or remedies in any
way.
Disclaimer of Warranty
WestPA.net Services are provided on an "as available" basis. WestPA.net
does not make any warranties, express or implied, nor guarantee or imply
that the operation of WestPA.net will be uninterrupted or error-free or
that defects in WestPA.net will be corrected.
WestPAnet will make its best effort to provide the full capabilities of
the Service. Because of the complex nature of broadband services,
Internet congestion, and the shared nature of the service, it may not be
possible to provide the full capability of the Service at any particular
point in time.
No oral or written information or advice given by WestPA.net or its
authorized dealers, distributors, agents, or employees shall create a
warranty or in any way increase the scope of this warranty.
The Customer is responsible to initiate warranties for any premise
equipment purchased by Customer. Customer is responsible for the repair
or replacement of said equipment should it fail to operate.
Limitation of Liability
In no event will WestPA.net be liable for any incidental, consequential,
or indirect damages (including, but not limited to, damages for loss of
Business profits, Business interruption, loss of programs or
information, and the like) arising out of the use of or inability to use
the WestPA.net services, or information or software contained on
WestPA.net computers or transmitted through WestPA.net 's network, even
if WestPA.net or its authorized representatives have been advised of the
possibility of such damages.
WestPA.net 's liability to you for actual damages for any cause
whatsoever, and regardless of the form of the action, will be strictly
limited to the service fees paid to WestPA.net by Customer for the
period in which the damages occurred.
