Customer's initial
payment of WestPA.net web hosting fees indicates agreement with
all of the Terms of Service included in this document. If you have
just signed up and do not agree to these Terms of Service you can
terminate your hosting and receive a full refund of your hosting
fee within 5 business days of your signup. Otherwise, your hosting
fee will be refunded on a pro-rated basis. These Terms of Service
are subject to change by WestPA.net at any time. Check the website
for updates.
This agreement
represents the entire agreement between WestPAnet, Inc.
(hereinafter called WestPA.net) and the Customer. Customer agrees
to use WestPA.net in a manner consistent with any and all
applicable laws and regulations as well as WestPA.net policy.
WestPA.net provides
services that enable customers to publish and maintain Internet
web pages by way of WestPA.net hosting services. The Customer
desires to utilize WestPA.net services to host Customer's presence
on the World Wide Web.
You need to agree to
the following:
(1) The initial
hosting period begins from the date of this agreement and until
cancelled by either party. Billing is done in advance for each
hosting.
(2) Your web hosting
payment is due on the date indicated on your bill. WestPA.net
reserves the right to suspend access to your website and email for
non-payment if your payment is not received within 5 days after
your payment is due. There will be a $20 fee charged for
reactivation. Your e-mail, web site and username will be
eliminated at the discretion of WestPA.net for customers that do
not reactivate.
(3) You may terminate
your hosting at WestPA.net and receive a prorated refund for the
unused portion of the hosting fee. Web site design fees, domain
name registration, search engine submission and special software
purchases are NOT included in the hosting fee. Termination
requests must be in writing (mailed or faxed). For your
protection, domain moving and refund requests must be signed by an
official of the Company and be on Company letterhead. Email and
phone requests are not accepted.
(4) If you have an
existing domain name, WestPA.net will handle the paperwork to move
your existing domain name to WestPA.net at no charge. If you do
not have a domain name, WestPA.net will handle the paperwork to
create a new domain name for you. A domain name registration fee
will be billed to you directly by the Registrar, Network
Solutions, every year of ownership.
(5) WestPA.net
reserves the right to remove material from our servers that
WestPA.net deems objectionable. You agree to use all services in a
manner consistent with all applicable laws. You agree that you
(not WestPA.net) are solely responsible for the content of all
material posted to your web site, regardless of the source of that
material. WestPA.net has no obligation to approve, review, or
verify the content of any such material. Customer warrants that it
owns all rights to all material it posts to its web site,
including all copyrights and trademarks.
(6) Your site may not
be used for the sending of unsolicited or bulk E-Mail. Customer
may not reference its web site in or be referenced in any
unsolicited or bulk E-Mail, whether sent through this server or
not. We have a strict policy of not hosting any sites that
participate in any form of unsolicited or bulk E-Mail (called
"spamming"). WestPA.net reserves the right to determine what
constitutes "spamming".
(7)Whenever appropriate
WestPA.net will attempt to give notice of a violation to allow the
offending party to remedy the problem prior to action. However,
WestPA.net reserves the right to take whatever immediate action
our personnel deem necessary. Violations of these Terms may result
in filtering, blocked access, termination of service(s) or other
appropriate actions as solely determined by WestPA.net. Refunds or
credits are not issued in connection with any action resulting
from violations of these Terms.
(8) WestPA.net
services are provided on an "as available" basis. WestPA.net does
not make any warranties, express or implied, nor guarantee or
imply that the operation of WestPA.net nor any site hosted at
WestPA.net will be uninterrupted or error-free. In any case,
refund is limited to the hosting fee for any day(s) that downtime
exceeds 4 hours.
(9) You acknowledge
that you have read these Terms of Service and agree to abide by
them. You agree that this agreement constitutes the entire
agreement between you and WestPA.net and supersedes any other
agreements (verbal or written) or statements.
